{"id":35220,"date":"2009-09-29T00:00:00","date_gmt":"2009-09-29T05:00:00","guid":{"rendered":"https:\/\/www.unmc.edu\/newsroom\/2009\/09\/29\/a-note-on-new-hipaa-rules-regarding-privacy-violations\/"},"modified":"2009-09-29T00:00:00","modified_gmt":"2009-09-29T05:00:00","slug":"a-note-on-new-hipaa-rules-regarding-privacy-violations","status":"publish","type":"post","link":"https:\/\/www.unmc.edu\/newsroom\/2009\/09\/29\/a-note-on-new-hipaa-rules-regarding-privacy-violations\/","title":{"rendered":"A note on new HIPAA rules regarding privacy violations"},"content":{"rendered":"<div class=\"panel body-content\"><div class=\"panel__container\"><p>The first of several new HIPAA rules went into effect Sept. 23 that require patient and Health and Human Services notification following the discovery of a breach of unsecured protected health information (PHI).<\/p>\n<p>Any time a suspected privacy or information security violation occurs, faculty and staff should immediately notify:<br \/>\n<UL><LI>Privacy officers Sheila Wrobel (559-6767 or <a href=\"mailto:swrobel@unmc.edu\">swrobel@unmc.edu<\/a>) or Deb Bishop (559-5136 or <a href=\"mailto:dbishop@unmc.edu\">dbishop@unmc.edu<\/a>);<br \/>\n<LI>Information security officer Sharon Welna (559-2545 or <a href=\"mailto:swelna@unmc.edu\">swelna@unmc.edu<\/a>); or<br \/>\n<LI>The ITS help desk (559-7700).<\/UL> <\/p>\n<p>The privacy office will further investigate suspected violations to determine if patient notification is required and send notification accordingly.   <\/p>\n<p>The types of violations that would likely require patient\/HHS notification include:<br \/>\n<UL><LI>The loss of an unencrypted laptop or thumb drive that contains PHI;<br \/>\n<LI>Misdirected mail, e-mail or faxes with PHI to a non-health care related facility or individual; and<br \/>\n<LI>Workforce members who intentionally access medical records of friends, family or others without a job-related need to know such information.<\/UL><\/p>\n<p>HIPAA enforcement has increased nationally. Federal prosecutors in several other states have recently filed criminal charges against health care workers for improperly accessing patient information.  <\/p>\n<p>For more information, contact the
